            Delegate Miley moves to amend the committee substitute on page five, section thirteen-c, line seven, following the word “amount” by striking out the period, inserting a colon and the following proviso:

            “Provided, That if it is determined by the trier of fact that no damages would have occurred to the plaintiff but for the actions of a particular defendant, that defendant shall be liable to the plaintiff for not less than that defendant’s percentage of fault and not more than the maximum damages that can be recovered by law by the plaintiff.”
